    Feeders ponder NAFTA challenge

    Alberta feedlot operators are considering a trade challenge against the United States for damage caused to the Canadian cattle industry by the closure of the U.S. border. Feedlot operators Rick Paskal, John Vander Heyden and Cor Van Raay and former Canadian Cattlemen's Association general manager Charlie Gracey were in Washington, D.C., last week discussing with American government and cattle industry officials a Chapter 11 challenge under the North American Free Trade Agreement. It would be the first time in the history of NAFTA that Canadian cattle producers have launched such a challenge. For a challenge to be successful, the Canadians would have to prove the border closure changed from a health issue into a political issue and caused financial harm to Canadian cattle producers.

    "What options do we have? We just feel these people have caused us literally millions of dollars through their actions there," said Paskal, who runs a feedlot near Picture Butte. "We don't feel we can hang on that much more."

    Under a Chapter 11 investment challenge, Canadian producers must prove the American action is harming a Canadian's investment in the U.S.

    Paskal said the feedlot operators believe they have a winning case because Americans are violating NAFTA's phytosanitary rules by not basing border decisions on international animal health guidelines. The feedlot operators also argue that they have made a substantial investment in the U.S. cattle market.

    "We would not have built this industry in Canada to anything near where it was if we didn't have access to the American marketplace," he said.

    "We're saying our access to the marketplace is our investment in the United States."

    Peter Clark, an Ottawa trade consultant, said Chapter 11 challenges can be arduous.

    "These things are not fast, they're not cheap and the United States follows what I would call the scorched earth policy of fighting it. Before you go into it, you better realize you're going up against every resource that the United States government can throw at you."

    Clark estimated it would cost $5-$10 million and takes years to fight. Jack DeBoer, a feedlot operator from Monarch, Alta., is watching the plans closely.

    "At some point it's no longer a health issue, it's protectionist. As producers we've lost an awful lot of money."

    However, DeBoer said he is not sure if the time is right.

    "We don't want them to start moving all their resources over to the challenge instead of getting the rules in place. It's got to be timed right."

    Hugh Lynch Staunton, vice-president of the Canadian Cattlemen's Association, said when his group investigated the possibility of a Chapter 11 challenge, it was given low odds on winning it and cautioned against the action. At best it would divert resources away from working toward a negotiated solution, he said, and at worst it would be considered a hostile act.

      I think even if we lost, at some point you have to let people know that you not just going to smile at them with a welcome mat across your face. We do have to stand up for ourselves. We work hard and we deserve respect. How bloody arrogant but truthful was it for God loves the us to say we won't do anything about our situation, we don't have the guts...we'll maybe we have to get some guts.

        I said it one I've said it a dozen times. It's a trade issue, therefore the only way to fight tade issues is with trade issues. Seal up the ports to Japaneze products and shut off the gas and power. It would only take a day or two of that and guess who'd be at the table.
        Contrary to what CCA says they were advised that they stood a very good chance of winning the cort chalenge last summer.

                I for one liked Bob Speller. And I'm not afraid to say it, Liberal or not. He was the only Ag minister I can remember who actually seemed to know we were out here.

                When is the last time a federal ag minister walked into an auction mart in Western Canada?

                Never, as far as I can remember.

                Even though he couldn't get the border open for us before the election, I always had the feeling that he was really trying to do it.

                A politician who actually takes his job seriously and works for those who are depending on him, instead of for himself first is a rare thing indeed.

                He will be missed.

                As for his replacement, they'd better get on it fast. This is not the time to be without some direction from the government!

                  kato - I'm suprised! Any cabinetwit minester who has the gal to get up during in the crisus and predict the border will open in August, has no common sence or professionalizm. Even if he knows it will open then he had no business saying that without guarantee.

                    I agree Rusty, we had a similar experience in the UK with BSE - at one point the French were refusing to accept our exports once they were approved again so after a long political stalemate British consumers were urged by the Government to stop buying French wine etc and within weeks the French were starting to cave in - unfortunately an election was called and our politicians backtracked and the issue eventually took several years to resolve in the European courts. We could have beaten them with these unofficial trade sanctions in about six weeks. It's the only language protectionists understand.

                      There is no point taking them to court, once again only the lawyers would benefit. Even if by some minor miracle we won the americans would just dream up some other excuse to close the borders and we would be no further ahead. Maybe energy is the place to start but there again it would hurt the oil industry in this country and all their employees. Don't know the solution except talk some more and suck hole and some way or another the americans will open the border after the election. As for the Japanese they will be just about impossible to satisfy so have to hurt them economically.

                          At least Speller showed an interest. I think anything he said to us was on directions from above. One thing the Liberal party has, it's control over what it's ministers can and cannot say. If you talked to him next week, I bet you'd get a different story.

                              Not on your life will it be Goodale. Finance minister to Agriculture Minister??? He will stay on as Finance Minister....He is a close personal friend of PM PM...they share a cabin and condo together. No demotion in these cards... and Finance is too important to have two portfolios...
