Cebull has indefinitely postponed the hearing scheduled for July 27 until he has an opportunity to review the decision of the Appeals Court. It is thought now that the case may never be heard.

Montana court date on Canada cattle trade postponed

WASHINGTON (Reuters) - A July 27 federal district court hearing at which U.S. ranchers group R-CALF hoped to permanently close the border to imports of Canadian cattle has been postponed, a court clerk told Reuters on Wednesday.
The hearing in Billings, Montana, has been "vacated until further order from the court," the clerk said, adding that no other details were available.
A federal appeals court ruled last week that the U.S. government could end a two-year ban on imports of Canadian cattle imposed after Ottawa discovered its first domestic case of mad cow disease.
The appeals court decision overturned a March ruling by a Montana judge who temporarily halted, at R-CALF's request, the government plan to reopen the border to shipment of Canadian cattle under 30 months old.

This is the daily update for Wednesday July 20 brought to you by the Canadian Cattlemen’s Association and BMO Bank of Montreal. The July 27 hearing in U.S. District Court, Montana Division (located in Billings) has been postponed, with the potential that the case may not proceed. Judge Cebull issued an order this morning vacating the hearing. The order states that upon receipt of the Ninth Circuit Court of Appeals’ opinion setting out that court’s reasoning for reversing the District Court’s preliminary injunction, Judge Cebull will determine whether further hearings are necessary. It is not unexpected that a lower court would delay a hearing until such time as a higher court issues its reasons for a reversal such as the one entered in this case. The important fact is that trade in both live cattle and beef will continue while we await the Ninth Circuit Court of Appeals’ opinion, and Judge Cebull’s decision on next steps. I believe this is very good news? Now our cattle groups can start working at getting some of these dumber restrictions out of the way?
First one that comes to mind is scrap the branding garbage and a lot of the useless paperwork and start harmonizing our ID systems and age verification?
Hopefully in the very near future we can get the cows moving...culls as well as breeding stock?
Move closer into a better relationship with the NCBA so we can come up with policies that suit a North American beef industry?
Hopefully the American rancher has had enough of R-CALF and now recognizes them for what they are...a narrow minded focus group that is basically full of hypocrites and people who are so obsessed with hatred and fear that they can't see the forrest for the trees!
