An Italian grain company has won a $4.6 million appeal against the Canadian Wheat Board over a bad batch of wheat shipped in 1983.
This week the Manitoba Court of Appeal upheld a lower court decision from July 2009 that ruled there was "negligent representation" by the CWB and ConAgra Limited, an acredited CWB exporter against the plaintiffs, an Italian company, Pagnan S.p.A., and another company, Albionex (Overseas) Limited.
The shipment in question was from a 1982 Prairie wheat harvest that experienced widespread frost damage.
