    The Manitoba Court of Appeal has upheld a 2009 ruling saying the Canadian Wheat Board deceived a grain exporter and an Italian grain company in the sale of frost-damaged feed wheat in 1983. On Wednesday, the court issued its decision finding the CWB liable for negligent misrepresentation. Frost in 1982 resulted in a large quantity of feed quality wheat, some of which the CWB advertised as having "fair" milling attributes, according to court documents. "This wheat was not at all suitable for any purpose of baking bread. The wheat board eventually found that out and buried the information, and didn't make it available to anyone who was thinking of buying it, or had already bought it," says Winnipeg-based lawyer George Orle, who represented ConAgra Limited - the grain exporter - in court. ConAgra bought the wheat from the CWB and sold it to a buyer in Italy, who discovered it was of poor quality. The Italian grain merchant took ConAgra and the CWB to court for breach of contract and not delivering a product that met agreed-upon standards. This initial legal action was launched in 1985, but the trial only commenced in 2007. The judgment also favoured ConAgra in the company's cross-claim with the CWB. The CWB appealed the trial judge ruling, but the ruling was upheld yesterday, with the Court of Appeal saying ultimate liability rests with the CWB for misleading both ConAgra and the Italian buyer. The CWB must now pay damages of well over $4 million, plus the cost of the case, which could be in excess of $1 million. (POL) Those evil multinational companies ….exporting your grain.
