One neighbor hired plane and plane sprayed other neighbor crop. First neighbor is not co-operating won't even acknowledge damage. Drove by today and looks like far into the field damage and is obvious. What are the proper steps for the guy with the damaged field to take. No one should have to put up with that crap. I am surprised at the other neighbor that hired the plane, guess you don't know someone until money is involved sometimes. Any good agrologists etc. out there that do this sort of thing?

The damaged crop is canary the sprayed crop is wheat. The spray involved kills canary according to the label. The damage is quite obvious. Looks to me like the pilot thought the canary was wheat and wasn't careful, because it goes way way into the canary.
Thanks for the tip jd I'll pass it on. Any other tips would be welcome surely there must be insurance to handle this. Is it the farmer or the pilot responsibility and what if the pilot or farmer has no insurance, does anyone know?

We had comparable situation last year. Where
neighbour was doing round up burn off by we
think a plane when all around him crops were
up and thriving. We had Sk crop insurance
come around and measure the field. We used
yield maps to show difference and his
insurance company paid the difference.
Advice FWIW. Take lots of pictures document
everything you can think of. If you know the
date it was sprayed get environment Canada or
Weather_bug historical data.
Hopefully the neighbour or piolot have
insurance. I read in another post that
deductable is $20K. Either way it sucks. Good
luck.

It is up to the farmer to tell the applicator what is around his field. Now the mishap occured and it is the fault of the applicator. Proper thing to do is the farmer with the damage and the applicator get togather and assess the damage and hash out an agreement.The farmer that hired the plane is not at fault unless he never gave the applicator the right info on adjacent crops. Most cases acres damaged is agreed upon then take the type of crop times the price and come up with a dollars per acre value. May have to wait till fall to determine the yield on the un damaged part of the field.

many years ago when I had an isurance claim cause I spray drifted the neighbour, my insurance company asked me to get neighbour to give me a demand letter first. Then I could go back to ins company and after that the ins company and niebhbour hashed it out. He did OK.
