    Reciprocal Penalties

    Have not seen or heard of any new developments in contracts between grain shippers and railways.

    One report is that other commodity shippers are not supportive of more regulation and reciprocal penalties.

    As to grower-elevator contracts, do not know if new ones contain stated financial penalties for non performance.

    It is disappointing that so many directors of grower commissions and associations see grain companies as adversaries and want reciprocal penalties.

    As of August 1, 2014, all crop contracts with CGC licensed facilities must have a penalty clause. It is the law.

    I am still not sure how the rules are being applied. Has anyone taken the time to read a contract signed in the new crop year?

    I'll leave the discussion on the railway/grain company discussion to others. A question about how far you want government involved in commercial transactions/day to day business.
