      Tom, a question:

      If I grow an older variety, the problem is, the powers that be, often de-register the variety, and buyers will refuse to buy based on zero facts..

      Varieties get de-registered all the time. They were once good enough, but for whatever "reason", become no good for end use.

      Correct? That is only one singled out issue I see.

        If your pedigreed seed... is in a bag and sealed with original container... not been broken open... still germs good... OF COURSE you can legally sell it to whom ever you like. NO PROBLEM.

        Why would this be absurd??? All the proof of what it is clearly identifies its contents. It is in no way illegal to sell or resell one year old seed... if it meets the germination standard of the grade indicated on the bag.

        Unless you signed a contract separately, agreeing not to sell that seed again... which would be a totally separate issue.

          None of this is changed by UPOV91. PBR is here today. Only change is buying brown bag has legal implications where before selling was the trigger.

          If you have good quality what ever... there are many buyers wanting your product... just ask the organic people... they thrive on old varieties and special arrangements. UPOV 91 does not restrict these opportunities.

            But what about bulk seed? That 100 bushels that I did not seed for one reason or another. You saying no one will ask questions If I was to sell it to a neighbor next year because I did not want to grow it again.

              If you are a registered establishment under the seeds act, properly reported the carry over and regermed it... then yes you can resell the bulk seed. It is done every day.

                you want another crime.
                how about our govt. selling off research to private interests.
                now instead of paying a dollar or 2 once in taxes to breed a resistance into our crops.
                much better to pay a corporation 4$ a year til the end of time, and still never get own or get free access to it.
                that is Conservative business logic at it's finest.

                you just can not wrap your head around that logic can you?

                the list goes on and on and it is not about free Enterprise or property rights
                at all.
                it is corporate interests controlling the govt. and writing laws
                that actually destroy the things above.

                      So my point Tom, it was your argument stating a farmer could dig up and sell the seed he planted which was absurd since you just told me that unless the farmer was registered under the seed act he could not resell pedigree seed that he purchased but did not plant.

                      And, yet other than calling me absurd for wondering if equipment manufacturers would now have a precedent for calling for a technology fee on patented improvements from second owners, you have not explained why this is different or absurd.
