          thanks for posting the documents. i was not able to locate them. and for some reason tom would not post it. it is somewhat apparent why. tom should of launched a class action towards the real culprits. as pointed out by toms ammended arguments the blame lies within gov. dept. responsible for overseeing payments and scrutinising duties warranting such payments to be legitiment.

                    I retained another separate legal council in Edmonton after the January 27 Writ of Enforcement, was put on our farm by
                    1) Canadian National Railway and Canadian Pacific Railway.

                    Both my separate personal legal Council, and our farms long time Council remarked...
                    "They shouldn't have done that".

                    Appeals had not yet been concluded to the court costs at this point.

                    On the Writ for $423,000... binding all my farm land is written:

                    Mr. CNCP Council Averbach argued the case in Calgary... and was the one in Calgary... before the Alberta Court of Appeal; that called me personally a "Slandering Vexatious"... farmer who basically the likes of all farmers who should not be allowed back in a Court against CNCP. Yet CNCP aggressively and enthusiastically defended the railcar maintenance overpayment issue;

                    CNCP not objecting to us bringing this important legal issue that was novel before the Alberta Courts ...

                    UNtill after they won and had cleared the names of CNCP Rail.
