    If YOU were the CWB Minister, what would you do?

    #1. I would issue a written order to the CWB to immediatley get into compliance with NAFTA.

    Section 61.1(1) of the CWB Act requires the CWB to comply with NAFTA:

    “Implementation of the North American Free Trade Agreement
    61.1(1) In exercising its powers and performing its duties, the Corporation shall give effect to the provisions of the Agreement that pertain to the Corporation”


    The CWB do not comply.

    Canadian cowmen/feedlots have access to non-board feed grains that United States livestock producers cannot access. The Yankees can only buy CWB grain, not farmer-grain.

    Therefore, NAFTA is breached


    The same must be available outside as well as inside Canada.

    #2. Minister Parsley would instruct the CWB's spokeswoman, Deanna Allen to inform the CWB that the CWB have breached their legal commitment:

    Article 309 of NAFTA states:

    “….no Party may adopt or maintain any prohibition or restriction ….on the exportation or sale for export of any good [non-board feed grain, or non-board products] destined for the territory of another Party….”

    #3. I'd march into the Board of Director's meeting and recluse some of them them for knowingly breaching the Act that governs them, and demand the Code of Conduct Governance Committee subject them to investigation with an eye to punishment for breaking the law. Parliament's legislation is law.

    #4. Finally, I would march into the CEO's office and order him to grant export licenses to every bloody Western farmer applicant. Immediately. Or face dismissal.

            Let the CWB self destruct. The "single minded" deconstructors are in mind bending warp speed doing this job.

            SO be it. I have patiently waited this long... let them tear it limb to limb asunder and into oblivion.

            Best to let those who claim they can not survive without their security blanket... burn it. When they are cold... and have no one but themselves to blame... that will be sweet revenge enough for me!

              But Tom, what if you are also the Minister of Agriculture? You have a duty to farmers to get this beast off their backs.

              The licensing Part IV is NATIONAL LEGISLATION. Order the CWB to grant licences to producers equally across Canada. If they refuse, take licencing away from them. An exposing court challenge would be welcome and enlightening.

                If I we're minister (which is often Ag minister too)I would hold a bunch of consultations and meetings then I would do what I wanted to anyways. Then I would bluster and threaten anyone who didn't agree with me and hold some more meetings and drag the issue out so long that most would forget what the issue was anyways. Then I would leap up and announce (In my best DR.Evil voice) 1 Billion dollars... in small cheques to be divided up under some voodoo science program devised by the goblins working at gringots errr civil servants working in Ottawa. Then before I could actually accomplish much of any use I would be shuffled into a new portfolio where I could promptly forget everything and brag about my track record without ever really having to had made a real decision and the cycle could start all over again with a new Ag.(CWB) minister just like it has for the last oh what 10-12 years.....(across all party lines)LOL

                  I would provide the same marketing freedom grain growers outside the DA have to those contained within it.

                          That SHOULD be where we are required to go as:

                          1.)Seed Growers already have this opportunity INSIDE the "Designated Area";

                          2.) Manufactured Feed Producers already have this opportunity INSIDE the "Designated Area";

                          3.) Millers/Maltsters and food processors can import wheat and barley/products and arbitrage DOWN grain prices INSIDE both from inside and out of the "Designated Area";

                          By NAFTA law... there is not supposed to be a difference between the price inside and outside of Canada... and the CDN GOv. has an obligation to implement this statute.

                          If the price is the same inside and outside the "designated area"... there is NO PECUNIARY BENEFIT.

                          The CWB is sucking/blowing wind (at the same time)... and they know it.

                          Amazing what lengths people will go to to preserve power... no matter what principals they must compromise to do so!

                          Rod Flaman Knows all these facts.

                          Ken Ritter knows all these facts.

                          Ian McCreay is smart enough to know all these facts.

                          It is time they took responsibility for their actions... and operated on principal for a change... and do voluntarily what the Minister/P.M. should not be required to do by force... THE RIGHT THING... Marketing Choice.

                          Ontario has done this voluntarily,

                          The Aussies have done this without WTO requirement... because monopoly "single desk" operations are simply misguided foolishness... unless you like depreciating your growers assets and keeping them less prosperous (in taking produce @ less than Fair Market Value) than those in neighbouring countries that have logical sane trade policy.

                          The CWB is still doing what it was set up to do in 1943... take our grain and sell it to those it favours... in the national interest. That is the purpose of Trade and Commerce Powers; the CWB has used, from day ONE.

                            The CWB has a Code of Conduct. The Directors are required to follow the CWB Act. However, the the C of C doesn't prescribe the punishmentthat would be meted out if conduct requirements are breeched.


                            III. DUTIES
                            Duties for corporate directors emanate from common law obligations and the provisions of the statute or instrument under which the company is incorporated. The following duties are applicable to directors and are in addition to any enactment or rule of law or equity relating to the duties of directors:


                            D. Other duties

                            Federal and provincial legislation extends liability to directors for various actions or omissions (e.g. environmental protection legislation). Directors should familiarize themselves with the relevant legislation applicable to the CWB and should satisfy themselves that appropriate safeguards are in place to ensure the corporation's compliance with that legislation.

                            So, uh, if Directors know they are in contravention, and you are the Minister, how would you punish them?

                            Picking beer bottles in the ditches along the highways within a five miles radius from Candle Lake?

                            Or perhaps mandadory listening to ALL of the official 2007 and 2008 communication releases to the media, presented by the CWB's official spokeswoman, Deanna Allen, twice daily for 30 days?

                              Didn't have to report in writing at the border.

                              Then Sawatsky trucked into the usa

                              Goodale made an ammendment to the regulation

                              Exports were then required to report in writing...show their license at Customs.


                              Would somebody tell the Minster to undo that ammendment to the Regulation?

                              Then farmers don't have to report at the Canadian side any more
