    We have Grain Trade Australia here.
    Contracts must be written under these terms and
    conditions,if not don't sign them.
    Dispute resolution is via grain trade aust as well
    never heard it being used.
    Washout on unsupplied contracts is cost plus a
    few bucks or buy grain and deliver which a lot try
    to do.
    Most companies allow contracts to be rolled over
    with negation if that's the preferred option for
    framers

    Maybe we do need some farmer run entity to
    analyze contracts and educate farmers as to what
    the legalities of some contract clauses are. I
    personally won't contract anything that doesn't
    have an exit for unforeseen circumstances like
    drought, hail, etc. I don't mind the other side
    having those same protections in the event of
    labour unrest, riots, war, etc.

    What does bother me is one sided contracts
    where all the obligation is on the farmer with little
    or no legal obligation to complete the contract
    terms from the writer of the contract. Again, read
    any contract you're asked to sign, and ask for the
    removal of clauses that are predatory or unfairly
    apply to only one side.

      Is this something the Canadian Grain
      Commission can do? I think they have the most
      insight. They provide licensing.and.bonds for
      buyers. They have underwriters who are 2nd
      largest in the world.
      I like the idea of some common language and
      familiarity. Contracts do not have to be
      complicated.
