    Wedino read the whole post I am laughing what CWB supporters are saying, its not what I think I agree with what the guy did its helping farmers get a fair price for their product.

      This kind of export business happened for decades... ever since the end of the second world war.

      It is YOU... who do not understand... that seed wheat is not in the jurisdiction of the CWB Act or Canada Grain Act...Since the CWB Act, "Section 2(2) Unless it is otherwise provided in this Act, words and expressions used in
      this Act have the same meaning as in the Canada Grain Act, except that where in
      any definition of any such word or expression contained in that Act the word
      "elevator" is used, it has the meaning given to it under subsection (1).”

      Where anywhere does the CWB Act say it has any jurisdiction over seed for the purposes of the Canada Seeds Act. Seed guarentees genetic purity... not milling quality.

      1. It should be clear that if seed is not designated as grain for the purpose of the Canada Grain Act, it is also not grain for the purpose of the Canadian Wheat Board Act [CWB Act Section 2(2)] The CWB during the first 30 years of operations did not issue export licenses pursuant to Part IV of the CWB Act for Pedigreed Seed under the authority of the Canada Seeds Act. A whole seed industry in southern Alberta was built on this fact... and in the 1950's Certified seed was shipped globally... outside the CWB pool accounts... and the price determined by protien content rather than CGC grades.

      Here is what the CGC lawyers wrote in 1993 when I was a part of the Special Crops Act Initiative:

      "NON CANADA GRAIN ACT GRAINS

      Seed, forage crops and canary seed are not designated as grain for the purpose of the Canada Grain Act. Canary seed is not under the Act because the industry does not want canary seed regulated. Grade specifications are not needed by the industry because contract specifications for canary seed vary from contract to contract. This provides flexibility to market according to contract specifications and meets the needs of the industry far better than a grading system. Seed is covered under the Seeds Act while forage crops are not under federal jurisdiction because they are not generally exported but are consumed domestically."

        This is likely baloney. Bravado from anti-board types, attempting to create more chaos in the market place. If this did happen, then the guy should be prosecuted!

            What will be interesting is iwhen the Export Manufactured Feed Agreement Export Licenses are YANKED, and the Board begins to market that wheat and barley to the feed mills, so it goes through the pools.

            That should cause some angst.

            I'm way down in the USA where they won't even take a Canadian dollar. Period.

              There has to be the will by customs to prosecute and there needs to be a lot of effort into verifying the paper trail. It's not that easy. Also someone has to complain to customs. T4 export is fine if it is Seed Wheat . It's the verification process that's slack.

                Ah, you'll heartily advocate hiring enforcers, agastar.

                How about 200 extra enforcement officers that are employed AT Customs working on behalf of the CWB and paid for out of the pooling accounts?

                Seems like a project suitably umbrelled under your "Forcing by Jail" advocatation.

                  If the CWB is actually right... and our 'designated area' special genetic ability to attain higher quality actually existed... why on earth would you advocate giving the seed stocks to US growers... so as you so often tell me... they can come in and undercut the CWB in their special high quality IP Genetically pure wheat!

                  WITH 50-100X the volume they would have... rather than just dumping the pedigreed seed down the pit right now...without growing it!

                  Admit it Agstar77... this is a totally messed up system... that no one can logically explain... for it makes no economic sense from any angle you examine it from!

                    If you truly believe what skips so frightfully over your lips when you lick them, why is the CWB does not require seedgrowers to sell their grain to the CWB, and the seedgrowers can buy it back in order to export.

                    Then the profits from a Seegrowers pooling account can be:

                    1. Either shared equitably by all seedgrowers
                    OR alternately,

                    2. The profits from ALL pooling accounts can be shared equitably by all CWB transaction participants

                    OR WITH THOSE WHO TRULY BELIEVE IN EQUALITY

                    3. The returns from the CWB can be pooled and shared by all designated Area farmers along with all other farming sector poolings.

                      If you as the question about export seed sales... what about seed sales of wheat in the 'designated area' and why is the CWB not pooling seed and offering a seed pool account?

                      Why not a feed barley and wheat domestic CWB pool account?

                      The CWB is taking out the WCE feed wheat contract... and pushing it into oblivion... while trading MGE/KCBT/CBOT... wheat. The CWB could have easily traded our feed wheat contract... and simply added a premium on top for quality.
