    Denial isn't just a river... CN/CP nearly spent $2M to deny cost of Hoppercar maintenance?

    NEVER stand in the way of the CN/CP freight trains. The 'Hunter' has them fine tuned... they believe they create their own reality, their velocity is that great!

    Alberta Court of Appeal Calgary... yesterday;

    CN/CP argued they spent over $1.6M just on legal costs... plus $258,000 more to hire 8 experts;
    to prove that Hoppercar maintenance charges were at cost before 2007.

    In 2007-08 the CTA took about $72M off the grain freight cap... to reduce the 'embedded' overpayments to CN and CP on Hoppercar maintenance to the actual costs submitted by CN. CP refused to submit actual costs (were they lower?)... so are charged CN costs.


    CN/CP Lawyer Mr. D C Hodson QC argued that the awarding of legal costs against a farmer [TOM], would "Discourage Frivolous and dishonest claims". The Costs applied are "Legitimate to stop future actions". "NO Chill effect"here. This is an appropriate response to [TOM's] slander and libel for the notion that CN and CP possibly had taken $1 Billion from farmers...

    For Liberty to prevail there must be justice and the rule of law!

    It was truly astounding how well... and with sincere kindness... yesterday our Alberta Court of Appeal...treated those in our Criminal Justice system... I watched and listened carefully...

    Yet;

    Farmers who were sure they were being overcharged on the cost of hopper maintenance... get thrown under the loaded CN/CP grain train...
