    Liberals snuck this little gem into law last yr. Police can violate your constitutional enshrined rights to demand a breathalyzer without cause in your vehicle and and in your home. Welcome to your 1984 era police state courtesy of the Trudeau gestapo.

    I’ve heard this but I don’t understand it. So when I get home in the evening I have to wait 2hrs before I can have a beer on the deck. Is that correct?

        If suspected on the road the police can demand any sample they want to determine your sobriety without cause. That could mean a breathalyzer urine or blood. Its non negotiable. Refuse and your are instantly charged and your vehicle seized. That same power exists all the way to your house. Say someone sees you driving says you looked drunk at your house after arriving home in your car. But if you were sober when you arrived and had a couple beer in those hours at home, police still have authority.

        This is what you get when a lifelong dope smoker PM and a jumped up rookie justice minister get together to run your country.

              No mallee this is what passes for a govt in Canada now. Permissive progressiveness on one side, paired with crackdown on the other. So you can abort your kid anytime but you cant have a few beer at home. This isn't the Canada anyone remembers. I cant believe this is the Canada anyone wants but we have some real wankers here to use an aussie term. Canada will crackup, its just a matter of when.

                The general rule of thumb is that 2 standard drinks in the first hour will raise your BAC to 0.05%, and 1 standard per hour thereafter will maintain that level.
                If we are over .05 to 0.08 a fine over 0.08 loss of licence under 0.05 drive on.

                Canada am i reading this right if i blow .04 under legal limit the onus is on me to make sure i wasnt at some stage over .05 in the preceding 2 hours???

                I have and guess some of you have gone out for meal/function/party whatever had one beer maybe then two glasses of wine with meal all in space of a hour which would put you over then shit better not have anymore im driving home so you drink coke or soda water for next hour and half and your way under but your law your over still?? But your allowed to smoke a joint and drive?

                We have drug saliva testing when you get pulled over now as well as breathe test.

                Never lost my licence never will in my youth if i was over sleep in car for a few hours probably not allowed to do that in canada either

                  No. That would be as bad as driving here. Friend of mine was sitting in his car in a field years back while over, no intention of driving. Only avoided getting charged because his girlfriend had the keys in her pocket.

                    West Australian law regarding booze and drugs. Huge drinking culture here especially in rural areas. Actually hard to find competent young sober employees. Friday afternoon all you hear is "gotta get my missus to pick up a box of piss". Laws should be stricter with more enforcement. Seatbelt violation first offence is $500.

                      Far be it from me to introduce any actual facts into an Agriville discussion and I certainly am NOT defending the lunacy that has passed as federal governance for the last 4 years but this is a direct cut and paste from Bill C46:

                      The offence is not made out if all of the following conditions are met:
                      • The person consumed alcohol after ceasing to operate the conveyance;
                      • The person had no reasonable expectation that they would be required to provide a sample of breath or blood; and,
                      • Their alcohol consumption is consistent with their BAC at the time the samples were taken and with their having had a BAC of less than 80 at the time of operation.

                      Situations in which a person would have “a reasonable expectation” that they would be required to provide a sample would be decided on a case-by-case basis by the courts. However, a person involved in a serious collision causing death, bodily harm, or major damage should reasonably expect to be required to provide a sample.

                          Sorry for sounding like a numbskull but if you get pulled over and your 0.02 which is maybe one can of full strength beer you could still be in the shit ?

                          The onus is on you to prove youve had no more?

                          To cut out any grey areas you guys will ahve to move to even lower BAC think some EU countries are 0.02

                          You know if its 45c here, a friday or sat night, hot as a snakes wizzer my son and i will cook a bbq drink a box of mid strength 3.5% go to bed think nothing of it get and go to work next day. Missus might chip in and have one or two.

                          But usually only fri or sat nights id be stuffed if i lived in canada.

                          Have to admit i enjoyed visiting bars in small towns and chatting with locals in canada in 2017 cougars bar in turner valley were so hospitable hardly had to buy a beer looked like a rough joint but people had hearts of gold

                            I have little tolerance of anyone driving even after a couple of drinks so it doesn’t really bother me when they lower the legal limit.

                            But this hold you accountable after you’ve been at home two hours bit.... I wonder if they require eyewitnesses in order to prosecute. If someone calls in your vehicle and says they suspect you of driving drunk and the PO shows up 1.5 hours later at your house... how can they prove it was you? Even if you are drinking at that point. The person who reported you would need to be willing to go on record with it in my mind.

                            The whole reason you can’t get demerits from speeding or red light cameras is because they can’t prove it was you driving at that time, just that it’s your vehicle. You get the fine but not the charge. So how can they prove it was you driving hours before in order to charge for that.

                            I get the BAC going up and down part. I know people who have gotten off tickets because they said it’d been a couple hours since their last drink since they knew they were driving and a second test later proved that their BAC was dropping therefore supporting their claim. So charges were dropped. But I just don’t get the charging with no proof it was actually you driving part.

                              Being that I don't drink and have zero tolerance for those that drink and drive, I have no problem with this at all. Nothing more senseless than someone killed by a DD.
