    Far be it from me to introduce any actual facts into an Agriville discussion and I certainly am NOT defending the lunacy that has passed as federal governance for the last 4 years but this is a direct cut and paste from Bill C46:

    The offence is not made out if all of the following conditions are met:
    • The person consumed alcohol after ceasing to operate the conveyance;
    • The person had no reasonable expectation that they would be required to provide a sample of breath or blood; and,
    • Their alcohol consumption is consistent with their BAC at the time the samples were taken and with their having had a BAC of less than 80 at the time of operation.

    Situations in which a person would have “a reasonable expectation” that they would be required to provide a sample would be decided on a case-by-case basis by the courts. However, a person involved in a serious collision causing death, bodily harm, or major damage should reasonably expect to be required to provide a sample.

        Sorry for sounding like a numbskull but if you get pulled over and your 0.02 which is maybe one can of full strength beer you could still be in the shit ?

        The onus is on you to prove youve had no more?

        To cut out any grey areas you guys will ahve to move to even lower BAC think some EU countries are 0.02

        You know if its 45c here, a friday or sat night, hot as a snakes wizzer my son and i will cook a bbq drink a box of mid strength 3.5% go to bed think nothing of it get and go to work next day. Missus might chip in and have one or two.

        But usually only fri or sat nights id be stuffed if i lived in canada.

        Have to admit i enjoyed visiting bars in small towns and chatting with locals in canada in 2017 cougars bar in turner valley were so hospitable hardly had to buy a beer looked like a rough joint but people had hearts of gold

          I have little tolerance of anyone driving even after a couple of drinks so it doesn’t really bother me when they lower the legal limit.

          But this hold you accountable after you’ve been at home two hours bit.... I wonder if they require eyewitnesses in order to prosecute. If someone calls in your vehicle and says they suspect you of driving drunk and the PO shows up 1.5 hours later at your house... how can they prove it was you? Even if you are drinking at that point. The person who reported you would need to be willing to go on record with it in my mind.

          The whole reason you can’t get demerits from speeding or red light cameras is because they can’t prove it was you driving at that time, just that it’s your vehicle. You get the fine but not the charge. So how can they prove it was you driving hours before in order to charge for that.

          I get the BAC going up and down part. I know people who have gotten off tickets because they said it’d been a couple hours since their last drink since they knew they were driving and a second test later proved that their BAC was dropping therefore supporting their claim. So charges were dropped. But I just don’t get the charging with no proof it was actually you driving part.

            Being that I don't drink and have zero tolerance for those that drink and drive, I have no problem with this at all. Nothing more senseless than someone killed by a DD.

              Sorry but that view does not justify search, seizure and violation of your person. If we were so concerned about impaired driving then why in the bloody hell did we legalize dope? Maybe people should have been given a choice in the matter like a referendum. Do you support legalization of mary jane if it means Trudeaus jackboot brown shirts can invade your home under suspicion without warrant.

              Yeah, that's the kind of fd up country we are living in now.

                This is getting a bit of a scent of East German Stasi, what it's doing is buying time to make an arguement "possible" in court, its stacking the deck for the prosecutor.... think the was a youtube video posted here about talking to police and how a prosecutor can make you"appear" to be lying. If not search it if you care, definitely search if you "never lie and only tell the truth". On a side note, my ****tard neighbor that figured he'd get the land i was renting out from under me is gonna be getting a visit..... sarcasm. We are turning into a snitch state, see what happens if you don't call in a control burn these days, every dick and hairy Tom calls it in.

                    I understand the concern to a point here but this is not about going door to door doing breathalyzers but when you see your neighbor drive over your mailbox while throwing the empties on your lawn and your kids are riding their bikes down the same road it gives you the ability to report them and have some consequences. And I'm not a snitch but I know of a few abusers that blows my mind that they've never been caught. Having said that bal of anything under .08 is stupid to be punishable.

                      Are you safer 2 hours after a criminal offense happens? Ideally it never happens, in today's world you can't be protected from everything. Im not endorsing dnd but where's the line? Do you want govt and police in every aspect of your life because this is where it's leading. Govt will NEVER be proactive and prevent a disaster, but it'll be "vote for me and I'll get who hurt you" if they were proactive we would say "prove you saved me" they let the disaster happen. There's no votes chasing ghosts. The most famous words in a meeting is "well something needs to be done" after the fact.
