    The court will order that amount to be paid by the trespasser.

    Photo of license plate, vehicle, individual, signage, whatever... for evidence, location, time and date, all notarized is good, witnesses, if any, are very helpful.

    Just a few if those cases and the word should filter around pretty darn quick.

    Another instrument which stays out of the court system is a Notice of Liability.

    With the notarized claim and evidence as above, one needs only to send 3 notices to the perp and when he ignores it, - which he likely will - the claim is deemed binding by default or implicit consent.


    Hand him the fine, when he refuses, it goes in for collection.

    A really pinchy method is to file a lien on his property.

    I did this with a business that owned me a big chunk of money many years ago and found it, aahhh, shall we say, highly effective.

          As a landowner and hunter I wasnt in favor of changing tresspassing laws because we didnt have a problem. Things have changed and I will look forward to expecting to see more contact me for permission. The thing is a few slob hunters have ruined it for all hunters. To make matters worse the attitude of many "town" hunters toward private land access and almost its their "right". When they start grousing publically about how bad it is that you pushed a few bluffs of trees. Well they can stay the hell off. Contrast that with an encounter of a waitress in a restaurant checking my vax pass and relizing i was the land owner her husband had tracked down to hunt moose and the genuine thankfulness in being able to fill the freezer with a bull moose.

            I would guess Im even older than you Burnt maybe thats why you don’t see 2 sides to everything. Think about the negatives if there were no trespassing laws. They won’t bring it in because its too hard to enforce and a waist of time for the most part.

              Back in the 80s we had hunters cut fences and try to hunt from the truck window. One even trying to pick a couple deer out of the cows grazing on s rolled out bale. Used to have antique scavengers back in the day just driving around old yards.

              Doesn’t matter if they cause damage or not. You are the titled land owner and you call the shots on that dirt. Asking permission is the least any hunter can do. Maybe they should leave a clean $1000 bill for the privilege of walking on my land.

                  No, not just ego af5 there is real damage.

                  This year alone I have had one gate driven through and destroyed, another left open, and trees cut to access a field. I have had all kinds of garbage dumped in fields and approaches everything from paper products to old clothes to a mattress and wrecked furniture. I have had standing crops driven through and every wet year I have to deal with ruts left. Worst incident was a grass fire likely started by a hot muffler that burned 30 acres of pasture and fence.

                  Of course this was not all caused by hunters so I have no issues with those who ask permission and I grant access. Everyone else who have no respect for private property and laws are treated the same way as if they were the ones dumping and vandalizing

                  IT used to be there was respect for others but that is eroding more every year. This forum is a perfect example of the decline of respect for others over time with increased name calling and snide comments

                    Would have to look back a ways to find pictures but I had a calf shot about 5yrs ago, in the center of my pasture (not from the road) verified by fish and wildlife officer. I let pretty well anyone go that asks, with a few rules but it is irritating when they dont ask. Had one guy call my cell asking if he could have entry to one quarter which I granted, little did he know I was actually about to drive by, him and buddies were already loading the gutted deer in the truck when I went by maybe 2 minutes later.

                      For twenty years we said yes to anyone who asked. The only stipulation was, when are you coming and when are you leaving. But a lot of people want carte blanche. It got to be bird watchers, berry pickers, people canoeing, hunters, shed hunters, it was getting to be year round, and oh could we get some firewood while we are here, we would only take deadfall. So after a couple decades of abuse we just started saying no a few years back. There were to many deer before. There still are. Didn’t make a difference, but at least I can enjoy my own place now without wondering who is coming around the next grove of trees. As sheep wheat says if you are the only one to leave some habitat they all flock your way. But it doesn’t happen anymore. A few still ask but the word is no. The problem was it got be someone’s cousin or friend I gave permission two years back... don’t I remember? They would show up unannounced and just assume. If we don’t have property rights as a society, be it physical or intellectual, I think we are in real trouble. There are a few instances where someone comes on without permission but I have never had any resistance or back talk when they are told what the deal is and they don’t come back, and while my hired hand is a heck of a guy and been with me a long time, his initials do not stand for Rest In Peace. 😉
