The Board will NOT allow the maltster to deal directly with farmers OR they have the legal right to shut down the maltster(who then becomes the "works for the general advantage of Canada").


The Board becomes owner of the grain.
The Board contract comes first. Squarely first. No chicken/egg here, charliep, just dead duck malt barley growers.

As maltsters become more interested in identity preserved, the CWB's only reason for being is as heavy, heavy baggage.

You are worried about who does the probing, what color was the paper, who took your wife out to dinner, or who got a free trip to Winnipeg to the CWB weather office?

Just look at who issues your malt barley cheque.

Are you saying that if a farmer is told his grain is accepted for malt and he ships it and then it gets downgraded to feed, then he has not had a contract broken somehow??

After reading these comments from everyone, I would think that he could hire a lawyer and sue the company or the CWB for breach of contract somewhere along the line??

Even a verbal contract is valid is it not? Please correct me if I am wrong, it won't hurt my feelings for sure, I have been wrong before.(once)

I think that every farmer who can prove that his malt was not feed, was not tough, etc. and has the proper contract can sue the Board.

I don't know what the present contracts that farmers sign really stipulate, but if I was a betting man, I's bet that the contracts are all designed by the Board, for the Board, and punishes the farmer

The last crop of malt barley that I grew I recieved about $3.75...can't remember the year. The spot price anywhere U.S. was about $8.50!!

I asked a rep from Canada Malt (Board customer) what they paid the Wheat Board for my product...he said about $3.75???

I expressed disgust and then he proceeded to lecture me and a few other producers that we should be satisfied with what "the Board" (my buyer) (something wrong with this picture?)does for us...I wasn't...and quit growing board grains!

But ivbinconned, poor old Canada Malt cannot sneeze without asking the Board, because they are tied by the CWB Act as "designated as a work for the general advantage of Canada".

Now that is East Berlin stuff.

So if you start buypassing the Board, and dating a new market, Canada Malt is stuck dancing with the Board.

Now that's scarey for any corporation.

It's coming though! Young Farmers are moving away from the Board in droves.

Get a barley contract and see what it says.

We have a contract lawyer in the family, so it doesn't get me too uptight to read fine print anymoe.

I actually was thinking of planting some six row malt next year (feeding it to my cattle if not accepted for malt)but after reading this I think I'll just stick to a smooth awn six row variety. I refuse to deal with people who have bad reputations.

The opportunity for the CWB to risk manage and extract a premium was as practical and opportune this year as ever before with corn close to $3.00/bu.US

Practically zero risk in this cross hedge this year... as feed wheat or barley could have been delivered with a little innovation. Or even cross hedge Malt with that part of the industry!

WHen will "designated area" wheat and barley" producers understand that the CWB is not here to maximise returns... but to simply market "in an orderly manner"...


which is liberal double speak for as low a price as possible and still get away with it!

Why do you think liberals instituted such low initials!

Grain shipping... valued added... food producers... livestock producers... the benefit is massive to CSL... CNR... CPR... COnagra... ADM... this list is endless down to every last Canadian sitting at the Dinner table!

There is no harm in asking the CWB to send you a contract for your projected 2006 barley.

When you receive it, make the additions. Should reflect what you need to make your payments and commitments. Hand write them in.

ie:

"The CWB must take delivery of all grain dedicated to this contract BEFORE November 2, 2006 or this contract becomes invalid"

Initial it.

Make deletions, too. Just strike out what you don't like.

Initial them.

Initial each page in the right hand corner Page 1/3, page 2/3, page 3/3 etc.


Run off your copy and keep it.

Whip it back to the CWB. The worst they can do is reject it. And you will still have your backup marketing plan.

I believe some of Vader's comments represent CWB attitudes, which translated means:

Farmers will grow what the CWB tells you to grow, when the CWB tell you to grow it, and how much you will grow, and you will be satisfied with our compensation. End of discussion.

And the Vaders of the world also convey the message that he would be more than willing to promote limiting the supply of barley, in which case a lot of farmers like yourself, wouldn't be allowed to produce barley/poultry/milk etc.
