Here is a 'good news' letter I got...!
As you may have heard, the Alberta government has introduced a new piece of legislation, Bill 19 - the Land Assembly Project Area Act. The legislation is designed to allow the province to take over areas of private land for large-scale infrastructure projects. When the legislation was originally introduced, CFIB was very concerned about the impact this proposed legislation could have on rural landowners in Alberta. To representlandowners, CFIB has: - Emailed all rural Alberta members to get their feedback on the potential impact on their business- Wrote to the Minister of Infrastructure Jack Hayden and all MLAs to raise our concerns- Met with the Minister of Infrastructure, and Minister of Energy Mel Knight to raise our concerns- Reached out to other groups with similar concerns Recently, the government has announced some amendments to deal with some of the contentious items in the Bill: - A "project area order" can only be in place for two years, with no opportunity for renewal.- At the request of a landowner, the government must enter into negotiations to purchase a landowner's land in an approved project area. Compensation will be based on fair market value. - Strengthened their commitment to mandatory consultation with affected landowners. - They have removed the section that suggested that the Bill overrides the Expropriation Act. The amendments appear to be very reasonable and we believe that they address many of the concerns landowners have raised. However, we want to hear directly from you if you have further concerns. Given that the Bill places heavy emphasis on regulations, CFIB has asked the province to release the draft regulations before the Bill actually passes. This would give landowners further certainty about the Alberta government's plan. We will continue to monitor this Bill closely as it progresses through the legislature.
